Normalizar lo ilegal

Era abril de 2005. El entonces jefe de Gobierno de la Ciudad de México, quien se perfilaba a la carrera presidencial, violaba un amparo de un particular en contra de una presunta ocupación ilegal de la autoridad en un predio de Santa Fe.
Ese hecho se sumaba a una serie de polémicas durante su administración capitalina, incluyendo la opacidad en la construcción del segundo piso del Periférico —a través de fideicomisos ocultos— y los videoescándalos de Carlos Ahumada, que habían empapado a varios de los funcionarios de aquella administración, incluyendo a Carlos Ímazy a René Bejarano, funcionarios muy cercanos al actual presidente.
En ese momento comenzaba una serie de hechos que demostraban un estilo personal de gobernar, incluyendo el cierre de Paseo de la Reforma en 2006 por casi dos meses y la posterior campaña política de 12 años para llegar a la silla presidencial, financiada de forma inexplicable incluso hasta el día de hoy.
Lo que no sabíamos era que justamente se estaba ventilando la manera de ser y de actuar de un grupo político que ha buscado normalizar lo ilegal por más de dos décadas. Y es que nuestro mandatario lo ha dicho claramente: “No me vengan con que la ley es la ley”.
La evidencia es contundente. Existe un desprecio por el Estado de derecho y por el principio de legalidad que ya no nos sorprende ni preocupa. Lo tomamos como un hecho que no puede cambiar.
Por poner algunos ejemplos, ha violado datos personales de muchos ciudadanos en su mañanera, incluyendo los de Carlos Loret de Mola y María Amparo Casar. Sus obras faraónicas se han construido sin los permisos y autorizaciones ambientales. Ha pisoteado la normatividad en materia de adquisiciones públicas en cientos de procedimientos y tiene una policía —la Guardia Nacional— que hoy opera con un mando militar, aunque esto viola la Constitución.
Tan grave es la situación que se ha perseguido, con los órganos del Estado, a centenares de opositores y críticos al régimen. Si existen dudas, basta ver los procesos contra el propio Loret de Mola, Murillo Karam, Rosario Robles y Víctor Trujillo. Pero, eso sí, se han perdonado otros tantos “amigos” del gobierno como es el director de Segalmex, que estuvo involucrado en el desfalco de 15 mil millones de pesos.
El Presidente y su sistema han permitido que sus familiares y amigos se hagan millonarios a costa de su gobierno y, en lugar de ser revisados, fiscalizados e investigados, se han congelado todos los procedimiento en su contra, de la mano de la Fiscalía General de la República, la Auditoría Superior de la Federación y la Secretaría de la Función Pública.
La inacción de las instituciones es cada vez más descarada y las órdenes judiciales son ignoradas cuando así conviene. Se trata de un nuevo orden de las cosas basado en un sistema donde el presidente López Obrador y sus allegados se benefician de un pacto de impunidad, y buscan ampliarlo desapareciendo contrapesos, mediante la reforma al Poder Judicial que se está por discutir. Al diablo la justicia.
Y mientras eso pasa, los mexicanos aceptamos esta normalización de lo ilegal y la aceptamos como una nueva normalidad. Es más, le damos más poder a ese grupo político que lo único que busca es mantener su impunidad. “A los amigos, justicia y gracia; a los enemigos, la ley a secas”.
